Agreement to Terms

By accessing or using Avaatars ("the Service"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service. We reserve the right to update these terms at any time, and your continued use constitutes acceptance of any changes.

Service Description

Avaatars is an AI-powered avatar generation platform. Users can generate custom avatar images using artificial intelligence models, save favorites, and manage their creations. The Service requires credits to generate images.

Account Terms

• You must sign in with a valid Google account to use the Service.
• You are responsible for maintaining the security of your account.
• You must be at least 13 years old to use the Service.
• One person or entity may not maintain more than one account.
• You are responsible for all activity that occurs under your account.

Credits & Payments

• Credits are required to generate avatar images and are purchased through Stripe.
• Each avatar image costs 1 credit to generate.
• Purchased credits are non-refundable except where required by applicable law.
• If a generation fails due to a system error, credits will be automatically refunded to your account balance.
• We reserve the right to modify credit pricing with reasonable notice.

Generated Content & Intellectual Property

Subject to these Terms, you retain rights to the avatar images generated through your use of the Service. However:

• Generated images are created by AI and may not be eligible for copyright protection in all jurisdictions.
• You may use generated avatars for personal and commercial purposes.
• You may not claim that AI-generated images were created by a human artist.
• We reserve the right to use anonymized, aggregated data to improve our models and service.
• The Avaatars name, logo, and branding are our intellectual property and may not be used without permission.

Acceptable Use

You agree not to use the Service to:

• Generate images that depict illegal content, violence, or exploitation.
• Generate images intended to harass, defame, or deceive others.
• Create deepfakes or impersonate real individuals without their consent.
• Attempt to reverse-engineer, exploit, or abuse the AI models.
• Circumvent usage limits or credit systems.
• Use automated tools to access the Service without our permission.

We reserve the right to suspend or terminate accounts that violate these terms.

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from service downtime.

Limitation of Liability

To the maximum extent permitted by law, Avaatars and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

Termination

We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Any unused credits may be forfeited upon termination for cause.

Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
